WAIVER AND RELEASE OF LIABILITY
ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand that participating in martial arts and related fitness activities at [Gym Name], including but not limited to striking, grappling, sparring, strength and conditioning, and self-defense training, involves inherent risks of physical injury or illness.
These risks include, but are not limited to:
- Sprains, strains, dislocations, broken bones, concussions, or other injuries
- Transmission of communicable diseases, including but not limited to COVID-19
- Permanent disability or death
- I voluntarily choose to participate and assume full responsibility for any and all risks.
WAIVER AND RELEASE OF LIABILITY
Pursuant to Texas law, including Chapter 75 of the Texas Civil Practice and Remedies Code:
I, the undersigned, hereby release, waive, discharge, and hold harmless Mathis Minion Academy LLC dba Mathis Martial Arts, its owners, instructors, agents, volunteers, insurers, affiliates, and employees (collectively, “Released Parties”) from any and all claims, demands, liabilities, causes of action, costs, or expenses of any kind, whether known or unknown, arising from personal injury, property damage, illness, or death, related to or resulting from participation in any gym activities, even if such injury or damage is caused by the negligence of the Released Parties.
This waiver applies to all claims under common law or statutory law, including but not limited to claims under the Texas Deceptive Trade Practices Act (DTPA), and any claim for premises liability.
MEDICAL AUTHORIZATION
I authorize Mathis Minion Academy LLC dba Mathis Martial Arts staff to obtain emergency medical treatment for me (or my child, if under 18) if necessary, and I agree to be financially responsible for any associated costs.
MEDIA RELEASE
I grant Mathis Minion Academy LLC dba Mathis Martial Arts the irrevocable right to use my (or my child’s) image, video, or likeness for promotional or educational purposes, in print and online, without compensation.
BINDING AGREEMENT / SEVERABILITY / GOVERNING LAW
This waiver shall be governed by and construed in accordance with the laws of the State of Texas. If any provision is found invalid or unenforceable, the remainder shall remain in full force and effect. This waiver is intended to be as broad and inclusive as permitted under Texas law.
ACKNOWLEDGMENT
I certify that I am at least 18 years of age and fully competent to enter into this agreement. I have read this document and understand that I am giving up legal rights, including the right to sue the Released Parties. I sign it freely and voluntarily.
